Terms of Service

These terms govern your use of the FolioCradle apps ("the Software") and this website. FolioCradle is operated by James Graham, a sole proprietor in California, USA ("we", "us").
1. Marketplace terms come first
Apps obtained through the Atlassian Marketplace are also subject to Atlassian's Marketplace Terms of Use and any applicable Atlassian agreement. Where those terms conflict with these, the Atlassian terms govern the purchase, billing and distribution relationship.
2. Licence
Subject to these terms and to a valid licence, we grant you a non-exclusive, non-transferable right to install and use the Software within your Atlassian site for your internal business purposes, for as long as your licence is active.
3. What you may not do
- Reverse engineer, decompile or attempt to derive source code, except where that restriction is unenforceable under applicable law.
- Redistribute, resell, sublicense or host the Software as a service for third parties.
- Remove or obscure proprietary notices.
- Use the Software to violate the law or another party's rights.
4. Your content and your responsibility
You retain all rights to your content. We claim none, and as described in the privacy policy, we do not receive or store it.
The Software changes your data when you tell it to. It is a bulk editing tool, and bulk edits are consequential. You are responsible for reviewing the preview before applying changes, for the scope you select, and for ensuring you have the right to modify the content in question. We strongly recommend reviewing the dry run in full and testing against a limited scope first. Edits made by the Software create ordinary Confluence page versions, which can be reverted through page history.
5. Availability
The Software runs on infrastructure operated by Atlassian. We do not control its availability and do not offer an uptime commitment. We provide no guarantee that the Software will be uninterrupted or error-free.
6. Support
Support is provided by email on a reasonable-efforts basis during normal business days, as described on the support page. We do not offer a contractual response-time guarantee.
7. Fees
Pricing, billing, renewals, refunds and taxes for Marketplace purchases are handled by Atlassian under its terms. We do not process payments and do not receive your payment details.
8. Warranty disclaimer
THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA OR GOODWILL, ARISING OUT OF OR RELATING TO THE SOFTWARE, WHETHER IN CONTRACT, TORT OR ANY OTHER THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SOFTWARE WILL NOT EXCEED THE AMOUNTS YOU PAID FOR THE SOFTWARE IN THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
10. Indemnity
You agree to indemnify and hold us harmless from claims arising out of your misuse of the Software or your violation of these terms or applicable law.
11. Term and termination
These terms apply while you use the Software. Your licence ends when it expires or is cancelled through the Marketplace, or if you materially breach these terms. On termination you must stop using the Software and uninstall it. Sections 4, 8, 9, 10 and 12 survive.
12. Governing law
These terms are governed by the laws of the State of California, USA, without regard to its conflict-of-laws rules. The state and federal courts located in California will have exclusive jurisdiction, and both parties consent to venue there.
13. Changes
We may update these terms; the effective date above will change. Material changes apply from the start of your next licence term. Continuing to use the Software after that constitutes acceptance.
